These terms & conditions (“Terms”) apply to all orders placed by customers (“you”, “your”) via the website perfumepower.com.au (the “Website”) for purchase of products (“Products”).
By placing an order, you confirm that you have read, understood, and agree to these Terms. If you do not agree to all of these Terms, you should not place any orders.
2. Changes to Terms
We reserve the right to modify these Terms at any time. Any changes will take effect from the date they are posted on the Website. The version of Terms in effect at the time you place your order will govern that order (unless a change is required by law, in which case it may apply to prior orders).
To place an order, you may need to register an account. You agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately of any unauthorized use. We may suspend or terminate your account at our discretion for breach of these Terms.
5. Ordering & Confirmation
Product listings are subject to stock availability. We do not guarantee availability until you complete checkout. Once you submit an order and payment is accepted, you will receive an order confirmation via email. That confirmation constitutes a legally binding contract between you and us. If we cannot fulfil your order (e.g. out of stock, supplier failure), we will notify you and refund any amounts paid.
6. Pricing & Payment
All prices are displayed in Australian Dollars (AUD) and include GST (if applicable) unless otherwise stated. Shipping, handling, or other fees will be clearly shown before you complete your order.
Payment must be made in full at the time of placing the order. We accept methods such as credit card, PayPal, Stripe, or others shown on the payment page. Payment is not considered complete until the funds have cleared. We reserve the right to cancel orders if payment authorization fails.
7. Shipping & Delivery
We ship to the regions specified on the Website. Estimated delivery times are indicative only; delays may occur due to customs, carrier issues, or other external factors. Risk of loss or damage passes to you once the carrier physically delivers the Products to your nominated address. You should inspect products immediately upon delivery and notify us by email at support@perfumepower.com.au within 5 business days of any damage, defect or non-conformity.
8. Returns & Refunds / Right to Cancel
Consumer Rights under Australian Consumer Law (ACL):
You have certain statutory rights under the ACL which cannot be excluded, including guarantees that goods are of acceptable quality, match description, and are fit for purpose.
If you change your mind (i.e. not a fault of the product), you may request a return within 28 days of delivery, provided the item is unused, in original condition and packaging with invoice (and unless hygiene reasons prevent return once opened).
Return shipping costs for change-of-mind returns are borne by you, unless otherwise agreed.
For valid returns, we will refund the product price using the same payment method or via bank transfer (if applicable), within 14 days of receiving the returned Product in saleable condition.
If the item is faulty, damaged, or does not match the listing, you may request a repair, replacement or refund. We will cover return shipping costs for faulty or incorrect goods.
Any refund does not include original shipping charges (unless required by law).
9. Warranty & Liability
Where goods are faulty or do not comply with these Terms or statutory guarantees, our liability is limited to repair, replacement or refund of the goods (or part thereof) as permitted by law. We exclude liability for indirect, special, consequential losses to the maximum extent permitted by law. We do not accept liability for misuse, damage after delivery, or normal wear and tear of Products.
10. Intellectual Property
All content on the Website including text, images, logos, trademarks, designs, graphics, software, and data is owned by us or licensed to us. You may not reproduce, distribute, adapt, publish, display or create derivative works without our prior written consent. 11. Force Majeure
We are not liable for any failure or delay in performing obligations under these Terms if caused by events beyond our reasonable control (e.g. natural disasters, acts of government, strikes, pandemics, carrier failures).

These Terms are governed by the laws of Australia, consistent with the ACL. Any disputes arising in connection with these Terms will be subject to the non-exclusive jurisdiction of the courts located in your state or territory in Australia.
13. Severability
If any provision of these Terms is found invalid, illegal or unenforceable, that provision will be severed to the minimum extent necessary, and the remaining Terms will continue in full force and effect.
14. Consumer Guarantees & Other Rights
Nothing in these Terms limits, excludes or modifies your rights under the ACL. You may also have rights under other applicable law depending on your location (if you are outside Australia). In the event of any conflict between these Terms and applicable consumer protection laws, the mandatory legal requirements prevail.
